Amazon says Kindle users are entitled to e-book refunds

CHICAGO (Reuters) - Owners of Amazon.com's Kindle e-readers will receive refunds on past e-book purchases and see e-book prices drop if a judge approves legal settlements with publishers accused of fixing prices, according to the Internet retailer.

Amazon told Kindle owners in emails on Saturday that they could receive a refund of between 30 cents and $1.32 for e-books they bought between April 2010 and May 2012. The books must have been published by three publishers who have agreed to settle a lawsuit that accused them of inflating e-book prices.

The settlements are subject to court approval, and a hearing is scheduled for February.

If approved, the settlements would also limit the publishers' ability to set future e-book prices, which should lead to lower costs for Kindle users, according to Amazon.

"We think these settlements are a big win for customers and look forward to lowering prices on more Kindle books in the future," Amazon told customers in the emails.

Amazon did not immediately respond to questions on Saturday about how many customers could be affected.

The settlements came about after the Justice Department in April accused Apple Inc and five publishers of illegally colluding on prices as part of an effort to fight Amazon's dominance of e-books.

Three of the publishers - News Corp's HarperCollins Publishers Inc, CBS Corp's Simon & Schuster Inc and Lagardere SCA's Hachette Book Group - decided to settle.

Amazon was not a party to this lawsuit.

The three publishers have denied they did anything wrong, but agreed to settle the lawsuit to avoid the cost and risk of a trial, according to the settlement website, ebooksagsettlements.com.

If the court approves the settlements, the publishers will pay for e-book refunds that will be applied automatically to the Amazon.com accounts of eligible customers. Customers can use the refunds to purchase Kindle books or print books or request a check for the amount of the refund.

Electronic books more than doubled in popularity in 2011, with e-book sales making up 15 percent of the market last year, up from 6 percent in 2010, according the Association of American Publishers and the Book Industry Study Group.

While e-books increased in sales power, bringing in more than $2 billion in 2011, the majority of publishers' revenue still came from printed books, at $11.1 billion in 2011.

JCore's 480 Minute Workout Improved a Busy Mom's Fitness

What do you do when you live in an apartment, don?t belong to a gym and have a hectic schedule? How do you find time to workout? As a working mom with two young boys, it?s often a struggle to find the time to fit fitness into my day between work, school drop-off and pick-up, client meetings and other responsibilities.

Over the summer, I was introduced to the JCORE Accelerated Body Transformation System ? a 40-day program that claims to work around these constraints and transform your body. It was created by Jay Cardiello, a celebrity fitness trainer and wellness expert. I mean, he trains 50 Cent so his plan must work, right?

I will admit that I was highly skeptical before starting this program. Generally I try to workout for an hour, 4-5 days a week, mixing cardio with strength training. For JCORE, all you need is a 4?4 space, no weights, and 20 minutes a day/4 days a week. Was 20 minutes going to be enough?


I opened the calendar and found 40 days of workouts, rest days, and fit tests. Literally, I did not have to think about a thing. There are five different workouts, each fast-paced and comprised of 20 minutes of 30-second intervals of body-weight exercises. While 30 seconds might not seem like a long time, believe me, it can be intense. I was breathing hard and a sweaty mess by the end of the workouts. The exercises largely focus on your core, which helps build overall strength and stability. Think lunges, squats, planks, and fire hydrants. I modified many of these moves to make it easier on my knee. JCORE also starts with a Fit Test that allows you to gauge your progress week-to-week.

After finishing JCORE, I?m a convert to HIIT-like workouts. I love that I can get a kick-butt workout in 20 minutes. I?ve even done them in the time that it takes my husband to bathe the kids. And, I can do the exercises anywhere. I?ve taken them on vacation and plan on bringing them with me on a business trip.

The one thing that I did have trouble with was the meal plan, which tells you how many servings you should eat from each food group. In general, I have a hard time following diets and making sure I piece together the right combination of protein, fat, carbs, and veggies in my meals. However, JCORE did make me much more aware of my eating habits and help me to increase my intake of protein and vegetables.

Overall, I saw an increase in my fitness levels as gauged by JCORE Fit Test. While my goal wasn?t weight loss, I did lose two pounds and a couple of inches around my waist and thighs. My abs also emerged from hibernation. But most importantly, I felt toned and strong. I felt good about my body and was confident wearing my bikini at the beach.

Stan Lee Media sues Disney for billions over Marvel rights

(Reuters) - Stan Lee Media, a company that says it controls the rights to Marvel characters including Spider Man and Iron Man, has filed suit in U.S. District Court in Colorado against the Walt Disney Co seeking "billions of dollars of profits."

Stan Lee, no longer associated with the company, created many of Marvel's stable of comic book characters. The company claims Lee assigned it his rights to those characters in 1998 but then agreed a month later to assign the same rights to Marvel Enterprises.

Disney acquired Marvel Enterprises, which had been renamed Marvel Entertainment, in 2009 for $4.3 billion.

"The Walt Disney Company has represented to the public that it, in fact, owns the copyright to these characters as well as hundreds of other characters created by Stan Lee," the suit alleges. "Those representations made to the public by the Walt Disney Company are false."

The lawsuit focuses on successful movies based on Marvel characters that Disney has released since its Marvel acquisition. Those films include "The Avengers," which has grossed more than $1.5 billion in worldwide sales and is second only to "Avatar" and "Titanic," according to movie site Box Office Mojo.

"This lawsuit is without merit," Walt Disney said in a statement. "It arises out of the same core facts and legal claims that have been rejected by three federal district court judges."

Stan Lee Media, which said it was created in 1999 to "sue to recover damages to its assets," has been involved in what it called a "somewhat tortured history" of litigation dating from 2001 over corporate governance issues and the characters rights in cases filed in Colorado, New York and California.

They include suits between the company, its shareholders and Lee.

The latest suit claims that Stan Lee Media owns the rights "to the billions of dollars that Disney has generated, or allowed others to generate". It cites more than $3.5 billion from motion pictures, and what it calculates is more than $2 billion from "other media," merchandising and the Broadway show "Spiderman: Turn off the Dark."

Romney takes slight lead over Obama in presidential race: Reuters/Ipsos poll

WASHINGTON (Reuters) - Republican challenger Mitt Romney has pulled ahead of President Barack Obama in the race for the White House for the first time in more than a month and leads 45 percent to 44 percent among likely voters, according to a Reuters/Ipsos tracking poll released on Wednesday.

With just under four weeks to go before the November 6 election, Romney's surge followed his strong performance against Obama in last week's debate and erased a jump in support that Obama had enjoyed following the September 3-6 Democratic National Convention.

The poll showed that voters have warmed to Romney across a range of policy issues following the debate.

On Tuesday, the tracking poll had the two candidates tied at 45 percent. Obama had a steady lead in the daily tracking poll for most of September after the Democratic convention but Romney narrowed the gap after the debate and finally inched ahead on Wednesday.

"We have always felt that this was going to be a very close election and the numbers now reflect that - they are head to head, which is where they were pre- both conventions," said Ipsos pollster Julia Clark.

"This is where they'll remain, with some movement of course, until we hit Election Day," Clark said.

'SIGNIFICANT GAINS'

Romney gained significant ground against Obama among registered voters on a number of economic policy issues from October 6-10, compared to the four-day period leading up to the October 3 debate on domestic policy.

"Romney has made significant gains in terms of his perception with voters," Clark said. "He has really caught up to Obama on some key issues. The debate was perhaps the trigger, and the positive coverage Romney gained from the debate ... is also part of the explanation on this."

Poll respondents said Romney was best placed to handle the U.S. economy, help fix unemployment and deal with the federal deficit.

Romney's best showing against Obama was for his plan to tackle the federal deficit. A total of 39 percent of registered voters said Romney had a better approach to the deficit, compared to 27 percent for Obama. The two were tied at 33 percent on that issue before the debate.

While Obama lost some ground to Romney, poll respondents still said the president had the better approach on healthcare, the Social Security retirement program, the Medicare health insurance program for the elderly and disabled, gay marriage and the fight against terrorism.

On taxes, Obama still had an edge over Romney but the president's support dropped by 7 percentage points while Romney's rose by 4 percentage points.

The online survey of 1,027 likely voters was conducted between October 6 and October 10. The precision of the poll is measured using a credibility interval, which is plus or minus 3.5 percentage points.

Among the 1,199 registered voters questioned, the credibility interval is plus or minus 3.3 percent.
