New Details on the New iPhone, iPod Touch, iPad Mini Release?

iLounge has posted some new details on the release of the next iPhone, iPod touch, and iPad mini obtained from a highly reliable source - 'the first one to nail the new iPhone's unusual body design'.

Corroborating an earlier report, iLounge says the new iPhone will be ready to ship in mid-September with a launch date around the third week of September. They note Apple might delay a few days to build inventory if necessary but even so the launch would take place before October.

Apple is apparently working on at least two new cases for the phone. One is said to be similar to the current bumper case, the other is a 'very different' design that will have a major impact on the accessory market.

The new iPod touch will likely be announced at the same iPhone event and will grow in screen size and performance. An iPod nano has been rumored for release as well but iLounge has not seen enough evidence to confirm an update before this holiday season.

Also corroborating an earlier report, iLounge says the iPad mini will not be ready to ship as early as the iPhone and suggests it might even have its own debut event. Their source is firm on a November launch but this does seem a little bit late to capitalize on holiday shoppers.

Finally, the next generation iPad is said to keep the same basic shape, introduce the smaller 19-pin dock connector, a rear microphone for noise cancellation, and internal hardware changes that will improve performance and reduce heat. Although some rumors have releasing this minor update alongside the iPad mini, iLounge believes Apple will hold off and update the iPad early next year.

Massachusetts Eye and Ear researchers discover ... - Health Centers

? Eye / Vision Problems ? ? Genetics ? Jul 30, 2012

Researchers from the Massachusetts Eye and Ear Infirmary, The Children?s Hospital of Philadelphia, Loyola University Chicago Health Sciences Division and their collaborators have isolated an elusive human gene that causes a common form of Leber congenital amaurosis (LCA), a relatively rare but devastating form of early-onset blindness. The new LCA gene is called NMNAT1. Finding the specific gene mutated in patients with LCA is the first step towards developing sight-saving gene therapy.

LCA is an inherited retinal degenerative disease characterized by reduced vision in infancy. Within the first few months of life, parents usually notice a lack of visual responsiveness and unusual roving eye movements known as nystagmus. LCA typically involves only vision problems, but can be accompanied by disease in other organ systems in a minority of patients. LCA is a common reason children are enrolled in schools for the blind.

?The immediate benefit of this discovery is that affected patients with mutations in this new LCA gene now know the cause of their condition,? said Eric Pierce, M.D., Ph.D., co-senior author and director of the Ocular Genomics Institute at Mass. Eye and Ear. ?Scientists now have another piece to the puzzle as to why some children are born with LCA and decreased vision. The long-term goal of our research is to develop therapies to limit or prevent vision loss from these disorders.?

NMNAT1 is the 18th identified LCA gene. The gene resides in a region that was known to harbor an LCA gene since 2003, but the specific disease gene has been undiscovered until now. These findings will be published on July 29 in the online edition of Nature Genetics.

To identify NMNAT1, scientists performed whole exome sequencing of the family of two siblings who initially presented for evaluation of LCA but who had no mutations in any of the known LCA genes. Being seen by a multi-disciplinary team that took the case from careful clinical characterization to genetic testing to the research laboratory was an essential ingredient for success.

?By using whole exome sequencing, we found a mutation in a gene that no one could have predicted would be associated with LCA,? said Dr. Pierce.

?Whereas most of the known LCA genes involve dysfunction of retinal ciliary proteins necessary for light detection in the eye, NMNAT1 is uniquely distinguished by being the first metabolic enzyme linked to LCA,? said Marni J. Falk, M.D., co-first author and Clinical Geneticist at The Children?s Hospital of Philadelphia and University of Pennsylvania Perelman School of Medicine.

Having found a mutation in NMNAT1 in this one family, the investigators next asked if mutations in NMNAT1 also cause disease in other patients with LCA. Screening of 284 unrelated patients with LCA from the United States, England, France and India allowed them to identify 13 other patients with mutations in NMNAT1 as the cause of their disease.

Drs. Falk, Pierce and colleagues also studied how the identified mutations in NMNAT1 affect the function of the NMNAT1 protein, and thus may cause dysfunction and death of the light sensitive photoreceptor cells in the retina. Working together with Eiko Nakamaru-Ogiso, Ph.D., in the Department of Biochemistry and Biophysics at The University of Pennsylvania, they found that mutations in NMNAT1 appear to decrease the ability of the NMNAT1 protein to produce NAD+, a key mediator of cellular signaling and energetics.

Early treatment for patients with NMNAT1-related LCA could be especially beneficial.

Researchers found that all but the youngest patient with NMNAT1 mutations had damage to the macula, the center of the retina that is needed for central vision. ?This 4-year-old girl who doesn?t have central vision loss yet can possibly benefit substantially if we can devise a therapy for her NMNAT1-mediated LCA that prevents her from developing severe central vision loss,? Dr. Pierce said.

This study is an example of the multidisciplinary collaboration among the three institutions, using exome sequencing to discover genes involved in inherited diseases caused by mutations of a single gene. ?With the robust database and pipeline that we have developed, we have analyzed more than 300 whole exomes of patients and families with single-gene diseases,? said Dr. Xiaowu Gai, co-senior author and director of the Center for Biomedical Informatics at Loyola University Chicago Stritch School of Medicine. ?We are following up on a number of strong candidate genes. We are sequencing many new samples and expect similar exciting discoveries for other diseases.?

COLUMBUS, Ohio As liver cancer develops, tumor cells lose the ability to produce and release glucose into the bloodstream, a key function of healthy liver cells for maintaining needed blood-sugar levels.

The findings come from a study by scientists at The Ohio State Comprehensive Cancer Center Arthur G. James Cancer Hospital and Richard J. Solove Research Institute (OSUCCC James).

The loss of this type of glucose production, a process called gluconeogenesis, is caused by the over-expression of a molecule called microRNA-23a. The change might aid cancer-cell growth and proliferation by helping to maintain high levels of glycolysis under conditions of drastically reduced mitochondrial respiration, also known as the Warburg effect.

The findings suggest that suppressing miR-23a might reverse this process and offer a new treatment for hepatocellular carcinoma (HCC), the most common form of liver cancer.

The research is published in the journal Hepatology.

"This study identifies an important mechanism that severely blocks glucose production and its release from the liver as liver cells transform into cancer cells," says principal investigator Dr. Samson Jacob, professor of molecular and cellular biochemistry and William and Joan Davis Professor in Cancer Research, Division of Hematology and Oncology at Ohio State and co-leader of the OSUCCC James Experimental Therapeutics Program. "It is conceivable that delivery of an anti-miR23a to the tumor site could reverse this."

For this study, Jacob and his colleagues used an animal model that develops diet-induced HCC, along with primary-tumor samples from patients and HCC cell lines. The mouse model mimics different stages of human hepatocarcinogenesis. Key findings include:

  • Levels of enzymes in the gluconeogenesis pathway were drastically reduced, along with transcription factors involved in the expression of the genes encoding those enzymes.
  • miR-23a expression was significantly up-regulated in the animal model and in primary human HCC.
  • miR-23a suppresses the enzyme glucose-6-phosphatase and the transcription factor PGC-1a, two important components of the gluconeogenesis pathway.
  • Interleukin-6 and Stat-3 signaling cause the upregulation of miR-23a.

"Based on our data," Jacob says, "we conclude that gluconeogenesis is severely compromised in HCC by IL6-Stat3-mediated activation of miR-23a, which directly targets and suppresses glucose-6-phosphatase and PGC-1a, leading to decreased glucose production in HCC."

Jacob notes that since glucose-6-phosphatase is also essential for liver cells to convert glycogen (the storage form of glucose) to glucose, suppression of this enzyme can block all pathways leading to glucose production by the liver.

Assad forces pound Aleppo, declare Damascus victory

ALEPPO, Syria (Reuters) - The government of Bashar al-Assad declared victory on Sunday in a hard-fought battle for Syria's capital Damascus, and pounded rebels who control parts of its largest city Aleppo.

Assad's forces have struggled as never before to maintain their grip on the country over the past two weeks after a major rebel advance into the two largest cities and an explosion that killed four top security officials.

Government forces have succeeded in reimposing their grip on the capital after a punishing battle, but rebels are still in control of sections of Aleppo, clashing with reinforced army troops for several days.

"Today I tell you, Syria is stronger... In less than a week they were defeated (in Damascus) and the battle failed," Foreign Minister Walid Moualem said on a visit to Iran, Assad's main ally in a region where other neighbors have forsaken him.

"So they moved on to Aleppo and I assure you, their plots will fail."

Rebel fighters were clearly in control of parts of Aleppo, where Reuters journalists saw neighborhoods dotted with Free Syrian Army checkpoints flying black and white Islamist banners.

Helicopter gunships hovered over the city shortly after dawn and the thud of artillery boomed across neighborhoods.

Rebel fighters, patrolling opposition districts in flat-bed trucks flying green-white-and-black "independence" flags, said they were holding off Assad's forces in the south-western Aleppo district of Salaheddine, where clashes have gone on for days.

Opposition activists also reported fighting in other rebel-held districts of Aleppo, in what could herald the start of a decisive phase in the battle for Syria's commercial hub, after the army sent tank columns and troop reinforcements last week.

Cars entering one Aleppo district came under fire from snipers and a Reuters photographer saw three bodies lying in the street. Unable to move them to hospital for fear of shelling, residents had placed frozen water bottles on two of the corpses to slow their decomposition in the baking heat.

Other rebel-held areas visited by Reuters were empty of residents. Fighters were basing themselves in houses - some clearly abandoned in a hurry, with food still in the fridges.

A burnt out tank lay in the street, while nearby another one had been captured intact and covered in tarpaulin.

In a largely empty street, flanked by closed shops and run-down buildings, women clad in long black abaya cloaks walked with children next to walls daubed with rebel graffiti - "Freedom", "Free Syrian Army" and "Down with Bashar".

Rubbish lay uncollected. In one street families were packing vans full of mattresses in apparent preparation to flee.

Near the centre of town, most shops were shuttered, some with the word "Strike" painted over them. The only shop doing business was a bakery selling subsidized bread, where the queue stretched around the block. Burnt cars could be seen in many streets, some with the word "shabbiha" marked on them - a reference to pro-Assad militiamen.

U.N. Undersecretary-General for humanitarian affairs Valerie Amos said 200,000 people had fled the fighting in and around Aleppo in the last two days, and the violence across Syria made it hard for humanitarian agencies reach them.

"Many people have sought temporary shelter in schools and other public buildings in safer areas. They urgently need food, mattresses and blankets, hygiene supplies and drinking water."

Late on Sunday Syrian state television said soldiers were repelling "terrorists" in Salaheddine and had captured several of their leaders.

"Complete control of Salaheddine has been (won back) from those mercenary gunmen," an unidentified military officer told the television news, saying the gunmen included fighters from Saudi Arabia, Afghanistan, Turkey and Yemen. "In a few days safety and security will return to the city of Aleppo".

Reuters journalists in the city were not able to reach the district to verify whether rebels had been pushed out. The pro-opposition Syrian Observatory for Human rights said fighting continued in Salaheddine late on Sunday.

KILLING MACHINE

The leader of Syria's main political opposition group, the Syrian National Council, called for foreign allies to provide heavy weapons to fight Assad's "killing machine".

"The rebels are fighting with primitive weapons...We want weapons that we can stop tanks and planes with," SNC chief Abdelbasset Seida said in Abu Dhabi. He urged foreign allies to circumvent the divided U.N. Security Council and intervene.

"Our friends and allies will bear responsibility for what is happening in Aleppo if they do not move soon," he said, adding that talks would start on forming a transitional government.

Arab League head Nabil Elaraby said the battle in Aleppo amounted to "war crimes", and perpetrators would eventually be punished, Egypt's MENA state news agency reported.

The Arab League has suspended Syria and lined up with the West and Turkey against Assad. Assad's government blames Arab states, especially Saudi Arabia and Qatar, for the revolt.

Reuters reported on Friday that Saudi Arabia and Qatar had set up a base in southeastern Turkey to aid the rebels.

A Saudi Foreign Ministry spokesman declined on Sunday to comment directly but said Riyadh gave financial and humanitarian aid to the Syrian people. He also hinted at more direct support, saying countries should enable Syrians "to protect themselves at the very least, if the international community is not able to do so".

Assad's ruling structure draws strongly on his Alawite minority sect, an offshoot of Shi'ite Islam, while his opposition is drawn largely from the Sunni Muslim majority, backed by Sunni leaders who rule nearly all other Arab states.

That has raised fears that the 16-month-old conflict could spread across the wider Middle East, where a sectarian divide between Sunnis and Shi'ites has been at the root of violence in Iraq, Lebanon, Bahrain and elsewhere.

Shi'ite Iran demonstrated its firm support for Assad by hosting his foreign minister. At a joint news conference with Moualem, Iran's own Foreign Minister Ali Akbar Salehi rebuked the West and Arab states for holding the "illusion" that Assad could be easily replaced in a managed transition.

CRUCIAL TEST

In Damascus, where Assad's forces have pushed back a rebel offensive since a deadly July 18 bomb attack on his inner circle, many residents have fled fighting in the outskirts for relative safety in the heart of the capital.

In the centre, shops open only between 9 am and 3 pm, food prices have soared and no one dares walk outside after dusk, even in the holy month of Ramadan when streets are normally packed late into the night with people breaking the fast.

"To begin with I was with the regime, for sure," said Ahmed, from one of the southern suburbs where the army, backed by helicopters and tanks, launched its counter-offensive.

"But now, no, the regime must go. Take what they want with them, but they must go."

The battle for Aleppo, a city of 2.5 million people, is a decisive test of the government's ability to retake its two main cities. It has committed huge military resources to the battle there after losing control of outlying rural areas and some border crossings with Turkey and Iraq.

The British-based Observatory said 26 people were killed in Aleppo on Saturday and 190 across Syria. It reported fighting in Deraa, Homs and Hama. There was no way to verify its figures.

The Aleppo fighting follows the July 18 bomb attack, which killed four top security officials including Assad's defense minister, intelligence chief and powerful brother-in-law.

Interior Minister Mohammad al-Shaar, who was wounded in the attack, told state media the assassination had only hardened the authorities' determination to crush the revolt.

"Before this cowardly explosion, we were all working flat out. But now we will exert 10 times the effort to pursue those who threaten the security of our country," Shaar said.

Astros lose 11th straight

HOUSTON (AP) - , Drew Sutton scored on a wild pitch in the ninth inning to propel the Pittsburgh Pirates to a 6-5 win over the hapless Houston Astros on Friday night.

The loss was Houston's 11th straight, tying the franchise record for most consecutive losses in a season. The Astros, who have baseball's worst record, (34-67) last lost 11 straight in 1995. They have lost 24 of their last 26 games.

The Astros led 5-4 entering the ninth inning before rookie Starling Marte's bases-loaded sacrifice fly tied it up. A pitch from Xavier Cedeno got away from catcher Chris Snyder and allowed Sutton to score and extend Houston's misery.

It was the third time in the last four games that Houston has lost after entering the ninth inning with a lead.

Tony Watson (5-1) pitched a scoreless eighth for the win and Joel Hanrahan did the same in the ninth for his 31st save.

Alex Presley hit a solo home run for Pittsburgh in the fourth and Michael McKenry, who finished with three hits, connected on a two-run shot in the fifth.

Houston's Chris Johnson came a single short of the cycle and Ben Francisco had a solo homer and drove in two runs for the Astros.

The game was tied at 4-all when Johnson tripled on a ball that rolled up the corner of Tal's Hill in center field with no outs in the seventh. J.D. Martinez's one-out grounder to left field sent Johnson home to put Houston on top.

Johnson doubled in the first inning and had a solo homer in the third before his seventh-inning triple. Johnson walked in the fifth inning, but struck out in his last at-bat in the eighth.

Rhiner Cruz (1-1) came in for Houston with one out in the ninth inning. McKenry singled before Cruz issued consecutive walks to load the bases before Marte's sacrifice fly off Cedeno.

Houston starter Jordan Lyles allowed seven hits and four runs while tying a career-high with eight strikeouts in 6-plus innings.

McKenry doubled to start the seventh inning and chase Lyles. McKenry advanced to third on a sacrifice bunt before tying it at 4-4 on a sacrifice fly by pinch-hitter Josh Harrison.

Pedro Alvarez singled to start the fifth before McKenry's shot to the Crawford Boxes in left field got the Pirates within 4-3.

Francisco hit the third straight single for the Astros in the second inning to drive in a run and put Houston up 1-0.

The Astros added a run in that inning when Justin Maxwell scored on a sacrifice bunt by Lyles. The ball dribbled slightly down the right field line on the play and catcher McKenry came out to grab it. Maxwell evaded his tag and then dived onto home plate to extend the lead to 2-0.

Johnson homered for the second straight game to leave Houston up 3-0 in the third inning.

The Pirates didn't get a hit until Presley's home run to right field with one out in the fourth inning made it 3-1.

Francisco's first home run as an Astro came to start Houston's fourth inning.

Pittsburgh starter Jeff Karstens yielded six hits and four runs with seven strikeouts in five innings. He allowed two home runs on Friday night after allowing just one in his previous eight starts this season.

The Astros had a chance to add to their lead when Karstens loaded the bases with three walks in the fifth inning, but he retired Francisco to escape the jam.

Astros reliever Wesley Wright had a busy eighth inning. He got the first out of the inning, before moving to right field while Wilton Lopez came on to pitch to Andrew McCutchen. Wright, who appeared in right field for the second time in his career, returned to the mound after a double by McCutchen and retired the next two batters to end the inning.

NOTES: The Pirates have homered in 17 straight road games. ... The Astros claimed RHP Chuckie Fick off waivers from St. Louis on Friday. ... Mike Scott, who won the Cy Young award with the Astros in 1986, threw out the first pitch on Friday night as part of the team's 50th anniversary celebration. ... My husband and kids love kale ? no, really they do! I wasn?t always a big fan myself, but I learned about the many virtues of this amazing veggie and got creative to find ways to enjoy it. I?ll share our family?s favorite recipes in this post, but first let?s talk about why we should adore this vegetable.

Getting to Know Kale

A member of the Cruciferae clan, which makes it kin to cabbage, broccoli, Brussels sprouts, collard greens and cauliflower, kale is a descendent of the wild cabbage that grew in Asia Minor. My crazy roaming Celtic ancestors brought it to Europe around 600 BC, where it blossomed in popularity all over Europe into the Middle Ages. More of my adventurous ancestors (or folks like them) brought them to the US in the mid 17th century. This is one hearty plant that does particularly well in cold climates and the cooler seasons. I?m guessing this is part of its popularity.

According to WebMD, one cup of kale contains 36 calories, 5 grams of fiber, and 15% of the daily requirement of calcium and vitamin B6 (pyridoxine), 40% of magnesium, 180% of vitamin A, 200% of vitamin C, and 1,020% of vitamin K. It is also a good source of minerals copper, potassium, iron, manganese, and phosphorus. Oh boy!

As it turns out, vitamins A, C & K are super antioxidants of the phytonutrient variety ? this is good. The particular phytonutrients ? carotenoids and falvonoids are particularly associated with anti-cancer qualities. Very good. Aside from an awesome fiber content, it also contains lutien and zeaxanthin compounds, which are excellent for eye health. according to a study in the American Journal of Clinical Nutrition, a vitamin K-rich diet can reduce the risk of developing or dying from cancer. Excellent. There are other foods that contain vitamin K (spinach, collard greens, cheese), but none quite like hearty kale.

6 Ways to Love Kale

1. GD Meg?s Kale & Basil Pesto
Must give my daughter Mary credit for helping me come up with this one.

Ingredients

2 cups packed kale (stripped of the hard stems)
1 cup packed fresh basil
1/4 cup GD Meg?s cashew cheese
1/4 cup nutritional yeast
1/3 cup olive oil
3 cloves garlic (at least)
2 teaspoons lemon juice
1 teaspoon good salt

Instructions

Put everything but the oil in your food processor and get it going, adding oil slowly ? stopping to scrape the sides a couple of times.

2. GD Meg?s Gluten-Free Kale & Basil Pesto & Pasta YUM

Ingredients

Your favorite GF pasta
GD Meg?s Kale & Basil Pesto (above)
Capers
Sun dried tomatoes

Instructions

This one is really easy and fun and I have no idea what the measurements for anything are. It is up to you and your taste!

3. Saut?ed Kale

Ingredients

Bunch of kale, stripped of big stems and cut into bite-sized pieces
1/4 cup toasted pine nuts
2 tablespoons olive oil
1 ? 2 cloves garlic crushed
1 ? 2 tablespoons of lemon juice
Salt & Pepper to taste

Instructions

Put pine nuts in one layer on a baking sheet and bake @ 400 degrees for a few minutes (check and stir every couple of minutes, usually takes 6 ? 8 minutes). Heat up the olive oil in a large skillet, and add the garlic ? stirring for a minute. Then add the kale, stirring continuously till it starts to turn bright green (happens kind of fast) ? all on medium-high heat. Once it is a bright color, turn the heat down, add the remaining ingredients and try not to over cook it!

Strolling through security to enter Olympic Park, former British basketball star John Amaechi says he has been quite pleased with how his home country has opened these games.

The center paired with gymnast Nadia Comaneci to take the torch to the roof of the North Greenwich Arena earlier this month and is eager to see how Britain opens against powerful Russia in its men's basketball opener on Sunday.

"It's been wonderful so far, but the real work hasn't even started," Amaechi says. "That will tell the tale."

I SEE BY YOUR OUTFIT ...

Dressed head to toe in the British flag ? or, rather, AS the British flag ? Mick Burn wanted to find a spot along the road course to cheer cyclist Mark Cavendish.

But his outfit was so extreme, the man from Watford in Hertfortshire couldn't make it more than a few feet (meters) at a time without being stopped by fans wanting to pose for a picture with him.

"I've been mobbed all day," he says. And he's delighted by that fact.

It took him almost two years and 200 pounds (more than $300) to assemble the outfit, which consisted of everything from "posh golf pants," a waistcoat, his watch, eyeglasses and even his underwear. The toughest item was the sport coat, which cost him 50 pounds (about $75) on eBay.

Burn had thought his niece, rower Lucinda Gooderham, would be competing in these games. She didn't qualify, but he vowed to keep fine-tuning the outfit for Rio.

SPIRIT WILLING?

Not everyone in London is infected with the Olympic spirit. A couple of hundred demonstrators have gathered to protest the gigantic corporate and security sides of the games. Among them is one woman with a home-made cross stitch sign declaring: "Bugger the Olympics."

Beneath it, a second one adds: "And the Jubilee." Apparently she's no fan of the monarchy, either.

Most of the protesters say they don't object to the sporting competition. But they resent being told they have to support the games.

American Timothy Wang is already out of his first Olympics.

He lost his first table tennis match in four straight games on Saturday to North Korean Kim Song Nam. The experience lasted just a few minutes, beaten 11-5, 11-4, 11-7, 11-4 in the knockout tournament before about 4,000 fans.

He probably spoke for many first-time Olympians ? and even experienced ones ? about being very nervous.

"I walked out and as soon as everyone started cheering, I started to get goose bumps. My legs were shaking while I was playing. The nerves definitely kicked in. I tried to focus before the match, but I really wasn't expecting it when I came out. Over here every match is like center court and all the eyes are on you. In tournaments in the U.S., very few people are there."

Japanese volleyball coach Masayoshi Manabe is missing his trusty iPad. Turns out there's no wireless for the coaches to use at the Earls Court venue, something that isn't going over well.

"There is no wi-fi available here. All the teams are in the same condition. We are talking to the organizers," Manabe said through a translator.

Japan swept Algeria 3-0 in the opening match. For now at least, looks like they can do without technology.

Netflix chosen by many, but liked by few, says study

Despite being used by more than 80 percent of the respondents in a new Consumer Reports survey, Netflix video streaming service?doesn't seem to be very well-liked. Users mainly criticized its poor selection and did not see it as a viable option for replacing cable TV and movie rentals.

Over 15,000 people were surveyed by Consumer Reports for the study, and while it doesn't really bear out any new information, it does indicate that people understand the shortcomings of these services.

With Netflix, predictably, it's the selection. Who hasn't tried to find something to watch some night, only to spend it scrolling through endless early-2000s movies and obscure documentaries? One respondent noted that the latest movie he could find with George Clooney in it was 10 years old. Even for $8 a month, that's pretty shabby.

The larger take-away is that there still just?isn't a valid replacement for cable TV and movie rentals. You can go cheap with Netflix or Hulu Plus, but those are far from an all-access pass. You can pay per episode with Vudu or iTunes, but you may end up spending $30 just to watch a single season of a single show.?And independent movie rental places have a great selection and helpful staff, but no one wants to bet they'll be around in a couple years.

For now it seems people are satisfied to pay their money and get their cable, and then switch on the Roku or Apple TV when there's nothing good on. But given the amount of dissatisfaction with any given?part of this arrangement, be it cost, selection or convenience, the next few years may see more people than ever trying to cut the cord. Meanwhile, Netflix will take the abuse and somehow still maintain a stranglehold on its subscribers. Maybe it's Stockholm Syndrome.

Worker complaints over paid time on the rise

One of the most common complaints is workers who fail to get overtime pay as required by law.

There?s a simple workplace axiom: You put in your hours and get paid for them. Alas, this doesn?t always happen.

There?s been a record spike in wage and hour violation claims by employees thanks to sustained tough economic times, an increase in enforcement by the government, and confusion over -- or disregard of -- overtime pay provisions.

Wage and hour lawsuits have been soaring, according to federal judicial caseload statistics.

Already this year, there have been a record number of lawsuits filed under the?Fair Labor Standards Act, which covers wage and hour provisions, with 7,064 filed so far this year. That's?up from 7,006 filed for?all of?2011 and just 2,035 cases filed a decade ago, according to data compiled by employment law firm Seyfarth Shaw.

The Department of Labor's wage and hour division collected a record $224 million in back wages from employers in the latest fiscal year for more than 275,000 workers.

?Many workers still have a hard time taking advantage of their legal protections,? said Jeffrey Michael Hirsch, associate professor at the University of North Carolina?s law school and a contributing editor to the Workplace Prof Blog. ??Low-wage employees, in particular, often don't earn enough to attract attorneys, although class actions might help in some cases, so you see a lot of cases of unremedied wage theft.?

In those cases, he said, the Labor Department sometimes gets involved, especially to "send a message to employers."

The Labor Department, which sees 125 to 150 cases annually, has stepped up its efforts and pursues litigation when it cannot settle out of court, said?Sonia Melendez, a spokeswoman for the agency.

?The wage and hour division has stepped up enforcement efforts on behalf of vulnerable workers ? such as low-wage workers, migrant or seasonal laborers, workers with limited English language skills and workers who are unaware of their rights or are reluctant to file a complaint when subject to labor violations,? she said.

The bulk of wage and hour lawsuits deal with ?misclassification of employees, alleged uncompensated ?work? performed off the clock and miscalculation of overtime pay, said Richard Alfred, an attorney and chairman of Seyfarth Shaw's wage?and hour litigation practice.

He attributes the rise in lawsuits to:?

  • Weakness of the economy, resulting in layoffs
  • Outdated federal and state laws, which have failed to keep up with changes in technology
  • A lack of clarity in existing law, making it difficult to classify which workers need to be paid for overtime
  • Potential for lucrative recovery by plaintiffs and their attorneys

High-profile cases, such as a wage and hour case involving Wal-Mart, have gotten many employees, employers and lawyers to stand up and take notice.

In May, Wal-Mart agreed to pay nearly $5 million in back wages and damages to more than 4,500 employees who were misclassifed as being?exempt?from overtime rules. That paled in comparison to the $352 million the company paid in 2008 to settle allegations it didn't provide workers with proper rest and meal breaks but served notice that the Labor Department is paying close attention.

?Misclassification of employees as exempt from FLSA coverage is a costly problem with adverse consequences for employees and corporations,? said Secretary of Labor Hilda Solis at the time of the announcement. ?Let this be a signal to other companies that when violations are found, the Labor Department will take appropriate action to ensure that workers receive the wages they have earned.?

Massive monetary awards have increased the profile of such cases, making them attractive to some lawyers, Hirsch said. But he said the awards also have made?smart employers more careful. "One thing a lot of management-side firms do is perform internal audits for clients to make sure there aren't problems, particularly with overtime classifications," he said.

Not everyone is as focused on the issue, he added. ?I'd like to think that employers of low-wage workers are getting the message, but I'm not sure that's the case in general. You still hear about violations all the time.?
