Climate Controlled Seats Could Make Flying Coach Considerably Less CrappyIn an effort to make flying in the cheap seats a bit more comfortable, researchers at the Fraunhofer Institute for Building Physics have completely redesigned airplane seats giving passengers control over their individual climates. So one day fiddling with a vent might not be the only futile way to get comfy.

Access to fresh air is still one of the key factors to passenger comfort, but instead of a vent that noisily blasts down from above, the next generation seating will feature gentler inlets integrated into the armrests and the back of each seat. And to ensure the artificial breeze isn't blowing so hard as to dry out the occupant's skin, the inlets are custom-designed for maximum airflow without feeling, or sounding, like a tornado. The new seats also feature built-in heaters like you'll find in many cars, coupled with ventilation that pulls moisture away from the body for added comfort. Passengers will even be able to customize the humidity at their seat, without affecting those sitting next to them who might prefer flying in a desert instead of a rain forest.

The whole concept might sound a little over the top, but an uncomfortable passenger can quickly turn into a cantankerous passenger that poses a threat to flight crew or other travellers. Just In: A Gene That Makes Women Happy

The "warrior gene" in men might be the "happiness gene" for women.

A new study found that a low-expression form of the gene MAOA seems to give women good feelings, but it doesn't have the same effect in guys. In fact, it?s the same gene type that has been linked to aggression in men.

"This is the first happiness gene for women," lead author Henian Chen, of the University of South Florida, said in a statement.

MAOA, or monoamine oxidase A, controls the activity of an enzyme that breaks down serotonin, dopamine and other feel-good brain chemicals. In the study, the researchers examined how this gene was expressed in 193 women and 152 men. They also analyzed the subjects' self-reported happiness.

The researchers found that women with even just one copy of the low-expression type of MAOA were much happier than women with no copies. Meanwhile, many of the men in the study had a copy of the gene variant, but reported no more happiness than their peers without it, the researchers said.

The study, which appears in the journal Progress in Neuro-Psychopharmacology & Biological Psychiatry, controlled for various factors, including age, education and income.

"I was surprised by the result, because low expression of MAOA has been related to some negative outcomes like alcoholism, aggressiveness and antisocial behavior," Chen said in a statement. "It's even called the warrior gene by some scientists, but, at least for women, our study points to a brighter side of this gene."

Chen and his team speculated that testosterone might be to blame for this genetic gender gap, saying the hormone might mitigate the positive effects of MAOA in men.

Citigroup settles financial crisis suit for $590M

Citigroup has agreed to pay $590 million to settle legal claims by shareholders that its executives misled them about the bank's growing problems before the financial crisis.

The bank denied the allegations Wednesday, but said it agreed to the deal to eliminate the cost and uncertainty of litigating the class-action suit.

Plaintiffs say Citigroup executives kept mum between February 2007 and April 2008 about huge losses the bank faced on complex mortgage investments. When the problem was disclosed, they say, Citigroup's share price plunged. They blame the bank for their losses.

The case, filed in late 2007, was one of the first major lawsuits related to the toxic investments that fueled the financial crisis in 2008. It's also among the biggest proposed settlements of any crisis-related case.

In a statement, the bank said it is "pleased to put this matter behind us." It called the proposed settlement "a significant step" toward resolving the reams of litigation it faces as a result of the financial crisis.

Citigroup was one of the banks hit hardest by the crisis. As it faltered in the fall of 2008, the government made stronger banks take multi-billion dollar bailouts in part to mask Citi's weakness. Citi took direct bailouts totaling $45 billion and relied heavily on other emergency programs from the Federal Reserve. It has repaid the money with interest.

The bank said in its statement that it is "a fundamentally different company today than at the beginning of the financial crisis," having overhauled its risk management, reduced its risky investments and sold off non-core businesses.

Citigroup said it already has set aside enough money to cover the cost of the settlement.

The settlement is subject to court approval by U.S. district judge Hon. Sidney Stein in Manhattan.

Virtual Reprimand

Considering a question of first impression, a Virginia three-judge court imposed an agreed disposition of public reprimand without terms in a case that involved "the burgeoning use of the internet for advertising and marketing and to create 'virtual' law offices."

At issue were communications, representation agreements, letterhead and business cards that suggested that the attorney's firm was a law firm of multiple attorneys. The State Bar contended that the attorney worked with independent contractors who were not part of his firm.

The State Bar and the attorney agreed that the issue will be resolved by making the other attorneys firm employees.

The State Bar also had contended that the website and other communications were misleading in several respects, particularly with respect to areas of specialization. The attorney agreed to amend the firm web site to meet the concerns.

The court found a Rule 7.4 (communication of Fields of practice and certification) violation. (Mike Frisch)

Republicans launch convention assault on Obama

TAMPA, Florida (Reuters) - Republicans launched a sharp assault on President Barack Obama's economic record on the first full day of their convention on Tuesday and praised Mitt Romney as a leader who could rein in big government and kick-start a stagnant economy.

After a storm threat delayed the gathering one day, Republicans formally nominated Romney and his running mate, Paul Ryan, to challenge Obama for the White House in a November 6 election that polls show is tight.

Republicans repeatedly accused Obama of being hostile to small business owners, burying them under high taxes and excessive regulations that stunted job growth. His signature healthcare overhaul, they said, was big government run amok.

"It's time to end this era of absentee leadership in the Oval Office and send real leaders to the White House. America needs Mitt Romney and Paul Ryan and we need them right now," said Chris Christie, the combative New Jersey governor who delivered the convention's keynote address.

"Mitt Romney will tell us the hard truths we need to hear to put us back on the path to growth and create good-paying private sector jobs again in America," he said.

Republicans are using the convention to make the case for booting Obama from office while presenting a softer side of Romney, who has struggled to overcome a "likability gap" with the president and refute critics who paint him as a job-killing, out-of-touch former private equity executive.

Obama, campaigning in Iowa and Colorado, dismissed the Republican attacks and told a rally in Ames, Iowa, that the agenda his political foes were rolling out in Tampa made for a "pretty entertaining show."

He also accused Republicans of stretching the truth in a multi-million-dollar ad effort to get him out of the White House.

"They'll just make stuff up if they have to. They're doing it already," he said at an event in Fort Collins, Colorado. "Sometimes -- how do I put this nicely? -- they will just fib."

Polls show Romney trails Obama badly with women, and the convention featured a series of women speakers capped by Romney's wife, Ann. She said her husband had attacked every challenge - from reviving the struggling Salt Lake City Olympics to helping her battle multiple sclerosis and breast cancer.

"At every turn in his life, this man I met at a high school dance has helped lift up others," Ann Romney told the convention. At one point she shouted to fans: "I love you, women."

"A storybook marriage? Nope, not at all. What Mitt Romney and I have is a real marriage," she said in a speech timed to air during the one hour of prime-time coverage by U.S. broadcast television networks. "You can trust Mitt."

The former Massachusetts governor, who flew to Tampa earlier in the day, came onstage and gave his wife a kiss after her speech, getting a rousing reception from delegates.

But even as Republicans tried to show a united front against Obama, it was clear the bitter party divisions evident in the long and bruising presidential primary battle have not been resolved.

'DISENFRANCHISED'

Supporters of libertarian congressman Ron Paul of Texas and other conservative activists briefly disrupted the opening session, booing a decision to unseat Paul delegates from Maine and institute rules changes they believe will weaken their power in the next election cycle.

The rules changes, approved by the convention on a voice vote, will bind delegates to the results of a statewide vote and reduce the role of smaller state-level conventions where Paul had success.

Opponents of the move said Romney's operatives and the party's establishment were trying to freeze them out. Some noted that during the state-by-state roll call of delegates to count votes for the nomination, only Romney's vote totals were announced from the podium.

"We were disenfranchised by our party. We won't participate with this chaos," said Russell Montgomery, 52, of St. George, Maine. "We won't legitimize this fiasco. This is as bad as the other party - the corruption."

Former U.S. Senator Rick Santorum, Romney's chief rival in the primaries and a favorite of social conservatives who have had trouble warming to the former Massachusetts governor, addressed the convention but mentioned Romney by name only three times.

"Under President Obama, the dream of freedom and opportunity has become a nightmare of dependency with almost half of America receiving some government benefit," Santorum said.

Republicans painted Obama as a force for expanding government and said his policies had failed to bring down high unemployment or control budget deficits and federal debt.

The theme for the night, "We Built It," was a reference to Obama's "you didn't build that" comment in July that Republicans have used as an attack line against him. The comment referred to the government help that business owners receive.

"We can do better. We can do a lot better. It starts with throwing out the politician who doesn't get it, and electing a new president who does," House of Representatives Speaker John Boehner said.

Republicans hope the convention will not be overshadowed by Hurricane Isaac, which hit the Louisiana coast not far from New Orleans on Tuesday night, just before the seventh anniversary of Hurricane Katrina's deadly strike on the city. They also worry about being seen celebrating Romney's nomination while swathes of the Gulf Coast are under storm threat.

While Tampa was spared the brunt of Isaac, a destructive landfall in Louisiana could create uncomfortable split-screen television images of the convention juxtaposed with the hurricane.

The Republicans used the first night to highlight some of their rising stars. Christie's speech, aimed at firing up the party's conservative base, offered plenty of lessons he learned as a Republican governor in Democratic New Jersey who has become known for his in-your-face style.

"I know this simple truth and I'm not afraid to say it: our ideas are right for America and their ideas have failed America," Christie said. "We win when we make it about what needs to be done; we lose when we play along with their game of scaring and dividing."

Delegates said Christie's speech set the right tone for the gathering, which concludes on Thursday with Romney's nationally televised acceptance speech.

"It was powerful. The message was on target, reducing the deficit, reducing unemployment," said David Rusate, from Southbury, Connecticut, said of Christie. "He's a real people's man."

Artur Davis, a black former Democratic congressman from Alabama who switched to a Republican, said he had been fooled by Obama's promises in 2008.

"But dreams meet daybreak: the jobless know what I mean, so do the families who wonder how this administration could wreck a recovery for three years and counting," Davis said.

Broadband: Nigeria out for investors at ITU's summit

The Nigerian government is stopping at nothing to ensure that massive investment is made in the newly created broadband sector of the economy.

The government is using the economic transformation brought about by the telecom revolution in the country, to benchmark the contributions of broadband investment even as it has been seen as major economic booster of many developed countries of the world.

Armed with those facts, perhaps, the Communications Technology Minister, Mrs. Omobola Johnson has been drafted to lead a high powered delegation of industry players including government officials, policy makers, the regulator and several other stakeholders including telecommunications companies to this year?s International Telecommunications Union, ITU Telecoms World conference in Dubai, United Arab Emirate.

Leveraging on the development, the Executive Vice Chairman of the Nigerian Communications Commission, NCC,, Dr. Eugene Juwah also addressed a media parley last week, in which he outlined activities and strategies the country has lined up to ensure that every strong ICT investor that attends the Dubai event would at last emerge Nigeria?s broadband sector potential investor.

According to Juwah, main reasons for the country?s focus on broadband development is that no matter the tag that Nigeria was doing well in internet penetration, the high cost of bandwidth due to its unavailability on demand calls for worry.

He said that this poor state of broadband penetration and the attendant high cost of bandwidth have drawn government?s attention and cause it to continue emphasizing investment drive in that direction.

Juwah said that ?much progress has been made in voice telephony but data aspect of the sector is still poor and far between. Indeed, operators in Nigeria spend an average of between $400m and $500m yearly on bandwidth imported from foreign service providers and this has accumulative negative effect on the end users who have no choice but bear the high cost of this all important tool for fast internet speed and data transmission.

?That is why the Communications Technology Minister will be leading this delegation to correct this imbalance by courting investors to our sector?he added.

Although he admitted that some progress has been made in terms of providing bandwidth locally through Main One Cable Company, Glo 1 and the recently? the re-launched NigComSat-1R satellite, the cost of acquisition is still high.

?We want to tell potential investors that Nigeria remains the preferred investment destination in Africa. We will also explain to the potential investors the areas that still needed their attention since we have made a sizeable progress in voice telephony.

?For instance broadband as a technology is the direction the world is going now. It is about bringing developing countries like Nigeria to the knowledge economy where so much can be done on telemedicine, tele-education, via the internet?.

Juwah added that since missing out on the potentials of broadband development can also cause the country a huge economic developmental loss, it would also be suicidal to leave the campaign and provision in the hands of private investors who are largely profiteers.

The ITU Telecoms world conference in Dubai is taking place from October 14-18 and is expected to enable Nigeria to showcase its investment potentials.

The event brings together industry players, policy makers, regulators, operators, government officials, technology experts and investors.

Through the event, ITU applies technology solution to real world issues using ICT as a catalyst for social, economic and sustainable development.

According to the Secretary General of the United Nations, Dr Ban Ki Moon, the event has become the global platform for telecommunications regulation and standardization and a meeting point for those who desire the growth of ICTs in their countries. ?It brings together all the major players to ignite change in the way people communicate globally? he added.

Republicans not alone in hot, sticky Florida

TAMPA, Fla. (AP) ? Republicans have a perfectly logical reason to book their national convention in Florida, a swing state that Mitt Romney must win if he is to defeat President Barack Obama.

But who else in their right minds would consider holding such a large-scale event just when the state is at its hottest, stickiest and most vulnerable to hurricanes?

The answer? Lots of people.

Why? Because when the uncomfortable heat and humidity rise, hotel prices drop, and popular venues that are impossible to snag in high season are quite often available.

Everyone from Star Wars fans to beauty specialists, dancers, journalists, real estate agents and Asian business groups are planning to gather in the Sunshine State through the rest of this month and in September, one of the most active months for hurricanes.

(AP) NEW YORK - The price of oil rose Friday following signs that the Federal Reserve might act to boost the economy.

Benchmark U.S. crude rose 27 cents to $96.54 a barrel in afternoon trading.

Oil fell below $96 overnight on worries about Greece's spending then notched a tiny gain in morning trading in the U.S. The gains picked up after The Wall Street Journal reported that it had obtained a letter from Federal Reserve Chairman Ben Bernanke, saying there's room for the Fed "to ease financial conditions and strengthen the recovery." Bernanke wrote the letter to California Rep. Darrell Issa.

Tropical Storm Isaac was another factor behind oil's rise. It has the potential to reach hurricane force in the Gulf of Mexico, which would disrupt oil production and refining in the Gulf region.

"I think there's a lot of angst with what's going on in the Gulf right now," said Patrick DeHaan, a senior petroleum analyst for GasBuddy.com.

At the pump, the national average for gasoline rose more than a penny to $3.73. That's about a quarter more than a month ago and 16 cents higher than a year ago.

Among other petroleum products trading on the New York Mercantile Exchange:

- Natural gas fell 7 cents, or 2.5 percent, to $2.73 per thousand cubic feet.

- Gasoline at New York Harbor rose a penny to $3.12.

- Heating oil fell a penny to $3.13.

Christina Aguilera Sports Baseball Bat And LBD In 'Your Body' Shoot

Christina Aguilera was spotted on the set of her "Your Body" music video looking feisty and hot. Xtina was photographed in a long pink wig with blunt bangs, hot pink heels and a body-hugging dress.

Her look in the video certainly matches the Max Martin-produced track's sexy vibe, on which she belts "I am a freak, I'm disturbed/ So come on and give me your worst/ We're moving faster than slow/ If you don't know where to go/ I'll finish off on my own." In her hot little black dress, Aguilera was swinging a baseball bat around, and also driving around in a baby pink pickup truck.

In some of the shots she's chatting with a model-looking guy, but it's hard to tell if he's the video's love interest or just someone associated on the production end. She previously shot some of the video on August 20 when she tweeted out a photo of her leg in fishnet stockings. Her foot, in the hot pink shoe, rests on a green suitcase.

"Your Body" is the lead single off Aguilera's next record, her first since 2010's Bionic. For it, she's rumored to have hit the studio with a number of producers, writers and artists including British production team Xenomania, who have worked with Cher, Kylie Minogue and the Wanted, as well as her "The Voice" co-judge Cee Lo Green.

She has yet to confirm when the album will drop, but did explain to Rolling Stone earlier this summer that it shows her evolution. "I'm one that likes to collaborate. I love feeding off the creative energy, and it only makes me better," she said. "I'm on a continual path both personally and professionally. All-around, it's my goal to better myself as a person and an artist, and the show is one of those contributing factors and the guys are great friends at this point. It's fun collaborating with them at this point."

When planning on what to take financially with you as you travel, consider using travelers checks and essential credit cards instead of cash when you can.
To protect your money, its important to carry it close to your body either in a wallet that you can put inside your coat or in your front pants pocket. An even better idea is to put it underneath your clothing in a money pouch.
Pickpockets are around so stay alert especially when youre in a busy and crowded area, for instance, bus, train and airline terminals, popular tourist attractions and when using public transportation.
Its important to walk with an air of confidence, your head held high and back straight so you dont come across as if youre lost or distracted.
Pay attention to potential and intentional accidents, for instance, someone jumping in front a car and falling so that you are intrigued to examine what has occurred or a stranger who offers to take your picture or the most notorious, someone bumping into you causing your drink to spill or your bag to fall to the ground. STAY ALERT!
Beforehand:
Plan in advance. For example, are you traveling by car? If so, organize your maps and plan the route you are going to take before you leave the house. Also, for extra safety and to avoid delays, take your car to your local mechanic to get it inspected before you leave for your trip.
In case you lose or need to replace important documents i.e. passport, drivers license, credit cards and travelers checks, make a copy of each of the documents and leave them with a friend.
To create the illusion that youre still at home when you travel, time your lights and radio to come on as well as leaving the shades, blinds or curtains in their normal position. Regarding your mail, you should either stop it or ask a neighbor, family or friend to collect it for you.
Once youre arrived:

Make sure and lock your luggage and keep it as close to you as possible at any given time.
Regarding your valuables, keep them in the hotel safe, a safe deposit box or if you can, leave them at home.
To avoid unsafe areas, ask the hotel employees or even the police about which neighborhoods are the safest.
Install a portable motional sensor or door alarm on your door at the hotel.
Dont leave your belongings all over the hotel room, make sure and put them in your locked suitcase or out of sight.
Keep your guest room key safe by not displaying in public or leaving it at a restaurant or at the swimming pool.

Report any crime to the police immediately.

Romney touts Bain experience in Wall Street Journal op-ed

(Evan Vucci/AP)After months of negative attacks from his Democratic opponents, Mitt Romney is trying to turn his resume at Bain Capital into a positive for his campaign, arguing in a new Wall Street Journal op-ed that the experience he gained there would help him in the White House.

"The lessons I learned over my 15 years at Bain Capital were valuable in helping me turn around the 2002 Winter Olympics in Salt Lake City. They also helped me as governor of Massachusetts to turn a budget deficit into a surplus and reduce our unemployment rate to 4.7 percent," Romney writes in the opinion piece published online late Thursday. "The lessons from that time would help me as president to fix our economy, create jobs and get things done in Washington."

It's a message Romney and his aides have communicated previously on the campaign trail. But it still hasn't quite resonated with voters, amid withering attacks from President Barack Obama's re-election campaign and its allies over Romney's business record.

In the Journal op-ed, Romney argues that his experience at Bain confirmed his "belief in empowering people" and gave him an up close look at how things like high energy costs and massive regulations impact businesses. Echoing a story that has already been the subject of a Romney campaign ad, the presumptive Republican nominee cites Bain's role in building up Indiana-based Steel Dynamics by equipping it with new technology.

He says the experience taught him "that we must have a level playing field in international trade." "As president, I will challenge unfair trade practices that are harming American workers," Romney writes.

Among other things, Romney says his time at Bain offered leadership lessons that will help him to take steps to reduce the federal deficit. He also argues that he knows first hand what it's like to start and operate a business?a sly dig at Obama, whom he's frequently criticized for lacking private sector experience and accused of being hostile to businesses.

"I'm not sure Bain Capital could have grown or turned around some of the companies we invested in had we faced today's anti-business environment," Romney writes.

"I know what it takes to turn around difficult situations," he adds. "And I will put that experience to work, to get our economy back on track, create jobs, strengthen the middle class and lay the groundwork for America's increased competitiveness in the world."

Cops: Armed Wash. man arrested over Obama threat

FEDERAL WAY, Wash. --?The Secret Service on Tuesday arrested a Washington state man accused of making an email threat against President Barack Obama and brandishing a shotgun at officers who came to his door.?

Anton Caluori, 31, was arrested at an apartment in this south Seattle suburb for investigation of making threats against the president and assault on a federal officer, said Brian Leary, a Secret Service spokesman in Washington, D.C.


Caluori is scheduled to appear at 2 p.m. (5 p.m. ET) Wednesday in federal court, Leary said.?

The threat was sent to a general purpose FBI email address, U.S. attorney's spokeswoman Emily Langlie said.?

The FBI then notified the Secret Service, Leary said. He refused to discuss the nature of the threat but Federal Way police spokeswoman Cathy Schrock said she understood it was a threat to kill the president.

Speaking to Reuters, Leary described the email as "alarming."

A Secret Service agent and a Federal Way police officer went to an apartment in a four-plex at the Panther Ridge Apartments, knocked and announced themselves for about three minutes, then found themselves facing a man armed with a shotgun when the door opened, Schrock said.

"The shotgun was coming up to point in the direction of the agents," she said. "The two officers were able to close in and take control of the weapon before anyone was harmed."

The officers also seized a gun in the man's ankle holster, she said.

Because the resident made statements about explosive devices in the apartment, the Federal Way bomb squad was called to evacuate the four-plex and sweep it for explosives, Schrock said. None was found.

'A good boy'
"He has a good education, he's a good boy, but he's done a stupid thing," a woman who identified herself as Caluori's mother, Renee, told local station KOMO-TV?at the apartment scene.

"I don't know a whole lot," she told the television station. "How would you feel if your son got arrested? Never got arrested, was in the military, has a college education. And I'm just a little bit upset and shocked."

Schrock said she understood Caluori's mother lived in the apartment as well. The spokeswoman said the woman was allowed back into the apartment briefly to get some personal belongings. Her location was not known Tuesday night.

Federal agents began searching the unit after the all-clear Tuesday evening, Schrock said.

Federal Way police had no previous contact with the man, Schrock said.

Leary refused comment on any details of the man's history.?

What to Know About Foreclosures in Alameda ... - RealEstate.com

What is a foreclosure? Foreclosure is the legal process undertaken by a lender to recover the balance of a mortgage loan when the homeowner stops making payments. Since the home is security for the loan, the lender will force the sale of it to satisfy the debt.

In other words, if you, a homeowner, stop making payments on your loan, the mortgage holder, or lender, can repossess your property. But there are steps that a lender must take to repossess your property in California.

The first step a lender must take is to file a Notice of Default (NOD) with the county recorder. The lender has 10 business days after filing to mail the NOD to the homeowner. The property owner is given a certain amount of time to respond to the Notice of Default by paying the default amount. This time period is known as the pre-foreclosure period.

If the homeowner does not respond to the Notice of Default within three months by paying off the default, the mortgagee or lender will then file a Notice of Trustee Sale setting the date for a public auction. The Notice of Trustee Sale is also served to the homeowner.

When the date for the public auction approaches the sale may be cancelled for several reasons. A homeowner may pay off the arrears amount. The homeowner may have successfully completed a loan modification or short sale. There may have been a filing error. The homeowner?s right to reinstate the loan expires five days before the auction date.

If the auction takes place, the lender will place an opening bid. If an investor or other third party bids over the lender bid, the property will be sold to the investor or third party.

If there are no investor or third party bids on the property, which is commonly the case, the property will become part of the lender?s REO (real estate owned) inventory.

There are two types of foreclosure according to California foreclosure laws.

Non-Judicial Foreclosure is the most common type of foreclosure in California. There is no court trial required with non-judicial foreclosure proceedings. There is an expedited time frame for the foreclosure proceeding. There is no deficiency judgment against the homeowner, meaning that the mortgagee or lender can?t collect the difference between the amount owed and the amount received when sold at auction.

However, homeowners association liens extend 90 days beyond the foreclosure sale.

Judicial Foreclosures are very rare in California. They require court proceedings, have no expedited time frame, and carry with them the ability of the lender to collect a deficiency judgment against the homeowner.

Alameda County currently has 9,388 homes in foreclosure with an average sales price of $288,461, according to RealtyTrac.

Foreclosure Radar?s May 2012 foreclosure statistics show that the number of Notices of Default in Alameda County decreased about 10 percent from May 2011. The Notices of Trustee Sales also decreased from May 2011 by 41 percent.

Foreclosure inventory in Alameda County decreased about 28.20 percent from May of 2011. Pre-foreclosures also decreased from May 2011 by 19 percent.

In Alameda County, lenders are taking longer to resell their properties while investors resell their investment property at the same rate as May 2011.? These are the flippers who make repairs on the foreclosed property and then resell them as quickly as possible.
Foreclosure Timeframes

Cities in Alameda County with new foreclosures in the triple digits in June 2012 included Oakland with 431 new foreclosures, Hayward with 191, Fremont with 114 and San Leandro with 102 new foreclosures.

Other Alameda County cities with new foreclosures included Union City with 54, Berkeley with 53, Alameda with 48, Pleasanton with 47 and Dublin with 45.

Based on the data from Foreclosure Radar, foreclosure filings are trending down. The number of properties sold to investor third parties nearly equals the properties that reverted back to the bank to become REO inventory.

The Foreclosure Radar data indicates that investors are contributing in a big way to the market. They are buying and flipping foreclosed properties as quickly as they can. When inventors put their flipped homes on the market, they are greatly increasing the meager inventory many of Alameda County cities are experiencing. Investors are showing that they have confidence in the real estate market, and that is a good for everyone.

Riots in the northern city of Amiens have revived concerns about minority grievances and unrest in France.

As has happened many times before, local anger over the French police practice of spot-checking youths' driver?s licenses and other forms of identification helped sparked the rioting. This time, it resulted in two days of car burnings and 17 injured police in the city of Amiens north of Paris.

President Hollande vowed last night to restore order, and there was a relative calm in the neighborhood today, following police reinforcements. But when Interior Minister Manuel Valls visited yesterday and condemned the violence, he was met with a testy standoff, jostling, and booing.

Amiens is Hollande's first urban crisis test. The question here is whether Hollande can ? in a time of austerity ? aid the ghettos and make progress at reforming the much-hated get-tough police policies of his predecessor.

Amiens is an officially designated ?urban sensitive zone? in France. The zones are mostly comprised of minority black and Arab residents facing economic problems. In Amiens, the jobless rate is nearly 45 percent, and according to town officials, two in three young persons are unemployed.

Five years ago, former president Nicolas Sarkozy promised a ?Marshall Plan? of relief and aid to them, but under his minister Fadela Amara, the plan never materialized.

Police consider the gang behavior and hostility in the zones bad enough to label many of them, including Amiens, ?no go? areas, though the phrase is used loosely.

In riots two days ago, dumpsters and cars were torched, plate glass windows were smashed, and a restaurant was destroyed. Police reported that buckshot was fired, though another report called it machine gun fire.?

The police ID check that sparked the riots took place near the funeral ceremony on Aug. 12 of a young man who died in an unrelated traffic mishap.

Mr. Valls, the interior minister, visited the mother of the deceased yesterday. She complained to him of insensitive and provocative police behavior and said local residents felt they were treated like ?animals? by local law enforcement, according to local French newspaper Le Courrier Picard.

It?s a sentiment that is widely felt throughout the area. Zone residents claim they live separate and unequal lives that include frequent ID checks that they say are humiliating and do not take place in Paris or other large cities.?

In a recent Monitor report on the sensitive Paris suburb zone of Clichy-sois-Bois ahead of this year?s French election, nearly every young male interviewed said that they had been stopped and questioned or searched more than once in the previous year.

Clichy was the epicenter of the 2005 riots that started when two youth going home from playing soccer on the eve of Ramadan ran away from a police ID check and were electrocuted when they tried to take refuge in a power station. Within a week, the riots spread across France.?

Ten years ago, France?s police strategy changed from "community" policing to a more confrontational and forceful style.?

In 2005, as interior minister, Sarkozy, vowed to bring a Karcher into the riot zones, referring to the nozzle on water cannons used by French police. This week, Valls, speaking in Amiens, told locals he was not there to bring a Karcher, another potential signal of a policy change to come.

This spring, a grassroots effort in the form of a public lawsuit was filed in French courts for the first time against the practice of police ID checks, financed in part by an NGO supported by the philanthropist George Soros.

Hollande, who just completed his first 100 days in office, was elected largely because of his policies claiming to unify the people. Observers say he?ll likely try to respond to Amiens on that basis, though it?s too early to say exactly what that will look like.

As we sit and wait for this years GCSE results I was re-reading this wonderful piece on testing and education by Yong Zhao, Presidential Chair and Associate Dean for Global Education, College of Education at the University of Oregon, where he also serves as the director of the Center for Advanced Technology in Education (CATE)... "I was reading Jared Diamond?s brilliant book 'Collapse: How Societies Choose to Fail or Succeed', I found his story of how the Easter Islanders? race to build the most magnificent statues eventually led to their collapse chillingly similar to what is happening to American education...

The hundreds of stone statues on Easter Island have been one of the greatest mysteries on earth. Located in the southern Pacific Ocean, Easter Island is over 2,000 miles away from the closest land, Chile, and 1,400 miles away from the nearest island, which is uninhabited. It is also a very small island, only 15 miles long and 10 miles wide. Yet, on this remote and small island are over 800 giant statues carved out of stone. They are large and heavy?ranging from 15 feet to 70 feet and from 10 to 270 tons. The largest ever erected weighed over 80 tons. Some of them have a separate headpiece, a cylinder of red scoria that weigh up to 12 tons. When the first European explorer discovered it in 1722, the island was almost uninhabited, with just a few thousand people living in poor conditions without any advanced technology. The explorers did not find any large animals or trees that could be used to help move and lift the statues. How could the islanders have carved, transported, and erected the statues because ?organizing the carving, transport, and erection of the statues required a complex populous society living in an environment rich enough to support it? (Diamond, 2005, p.81) and such a society was apparently nonexistent when Easter Island was discovered?

Many theories have been proposed. ?Many Europeans were incredulous that Polynesians, ?mere savages,? could have created the statues or the beautifully constructed stone platforms? (Diamond, 2005, p. 82). They attributed these grand works to other civilizations and even intelligent space aliens. But Jared Diamond, a professor of Geography and Physiology of UCLA and a Pulitzer Prize winner for his book Guns, Germs, and Steel, presents a more compelling theory. Equipped with a large cumulative body of knowledge generated by archaeologists, historians, anthropologists, and other scientists, Diamond uncovers a history of tragic self-destruction on Easter Island. The giant statues were indeed created by the Polynesians who began to occupy Easter Island about 1,000 years ago, when it was covered with forests of big and tall trees, some of which reached to about 100 feet in height and seven feet in diameter. These trees could be used to make seafaring canoes that enabled more productive fishing. Easter Island provided habitats for many species of seabirds. Coupled with a rather sophisticated agriculture, Easter Islanders developed a civilization that once had an estimated population of 15,000. Such a population provided sufficient labor force to carve, transport, and raise the statues. The tall trees provided the necessary tools and materials to transport and raise the statues. The giant statues were also one of the primary causes of the collapse of the Easter Island civilization. The island was divided into about a dozen territories and each belonged to one clan. Diamond suggests the statues were raised to represent their ancestors and there was a competition going on between rival clans. Each chief was trying to outdo their rivals by erecting larger and taller statues, and later adding the heavy headpiece on the statues. The statues became a symbol of status, power, and prestige to impress and intimidate rivals. And because of Easter Island?s particular situation, building bigger statues became virtually the only race among the clans. As a result, the statues got bigger, taller, and fancier. The race was costly. It took tremendous resources to carve, transport, and erect these statues. It needed surplus food to feed the people working on the statues and thus required more farming land. Trees were cut down to build vehicles for transporting and supporting the erection. Ropes used to pull the statues were made from barks of the tall trees. As more, bigger, and taller statues were built, more trees were cut down. Slowly, the whole forest on Easter Island disappeared, so were all tree species. ?Immediate consequences for the islanders were losses of raw materials, losses of wild-caught foods, and decreased crop yields?The further consequences start with starvation, a population crash, and a descent into cannibalism? (Diamond, 2005, p.107, 109) Eventually, the Easter Island civilization collapsed, leaving hundreds of broken, fallen, and unfinished stone statues littered on a barren island.

Although there are competing theories pointing out that human activities may not be the only cause of deforestation and ecosystem collapse on Easter Island (e.g., some scientists suggest rats as another contributing factor), Diamond provides a convincing ?example of a society that destroyed itself by overexploiting its resources.? A significant driving force behind the overexploitation was the race to erect bigger statues. I can?t help making the connection between Easter Islanders? race to erect the statues and Obama?s Race to the Top initiative and proposed plan for reauthorization of NCLB, which has already set American education on a race of test scores for a decade. Some may object to this metaphorical connection by arguing that test scores represent the quality of education a school provides, the performance of a teacher, and students? ability to succeed in the future. But the chiefs and priests on Easter Island also believed that the statues represented the health and power of their clans, the performance of their members, and promise for a more prosperous future. Test scores have no doubt become American?s stone statue in education. America wants to outscore other countries on international tests such as PISA and TIMSS, just like the Easter Island?s rival clans wanted to out build each other. NCLB and Race to the Top force states, schools, and teachers to outscore each other with either a club or carrots or both. Whether it is the complex AYP calculation formula or the proposed even more complex value-added-measures, the ultimate measure remains scores on standardized tests. Whether it is the prescribed punitive measures of NCLB or the proposed ?reward for excellence? by Obama, the criteria are the same: test scores and the intention no different: outscore others. In their race to build bigger statues, Easter Islanders put increasingly more resources into carving, transporting, and erecting statues. Likewise, in America?s race to obtain higher test scores, American schools have invested more resources in raising test scores. A large proportion of schools have spent significantly more time on the tested subjects (math and reading) and reduced time for other subjects and activities. Teachers have spent more time preparing students for standardized tests and focused more time on tested content. Millions of hours are spent each year for students to take the standardized tests. Billions of dollars are spent each year on testing or simply measuring whose statue is larger.

Just like the Easter Islanders? obsession with building statues damaged their ecosystem, America?s obsession with test scores have already begun and will continue to damage its education ecosystem. American?s traditional educational strengths?tolerance of diversity, respect for individual difference, and celebration for creativity?are replaced with standardization so as to raise test scores. A broad and balanced curriculum is narrowed to what can be easily scripted and measured so as to raise test scores. What is more dangerous is that the Easter Islanders perhaps did not realize their imminent collapse before it was too late. Blinded by the short-term glory of their magnificent statues, they were preoccupied with creating even more magnificent ones while the last palm tree was cut down. Equally blinded by the potential of common standards and testing programs to improve test scores, the current administration is ignoring the real civil rights issues facing our children: poverty, unsafe neighborhoods, and unequal access to educational resources. Basking in the victorious sunshine of forcing some 40 states to change laws and policies and trade their constitutional rights to education for promised federal dollars, the Obama Administration may be getting closer to cut down the last palm tree in American education land. And ultimately, just like Easter Island ended up a barren island filled with big statues, America may succeed in raising test scores but it will likely end up as a nation of great test takers in an intellectually barren land."

Celebrity chef Cat Cora avoids jail time for DUI

Celebrity chef Cat Cora will not be doing any jail time for her DUI citation in June as long as she meets the requirements of the court after pleading no contest on Friday.

The Food Network star pled no contest to driving with a blood alcohol level of .08 or higher and was sentenced to three years? probation and fined $2,386, according to a spokesperson for the Santa Barbara County District Attorney. She also has to attend nine months of DUI school and received a 120-day suspended jail sentence that she will not serve as long as she fulfills the other requirements. Her penalties are the standard protocol for first-time DUI offenders, according to the spokesperson, so there?s no preferential celebrity treatment here.

Cora, 45, is best known for her role as an Iron Chef on the Food Network?s ?Iron Chef America? and as the co-host of Bravo's ?Around the World in 80 Plates.? On June 17, she was arrested for DUI after rear-ending another vehicle at 6:15 p.m. at low speed in her 2007 Chevy Tahoe. No one suffered any injuries, but the female driver of the 2001 BMW 325i told officers who came to the scene that she believed Cora was intoxicated. Cora told police she had consumed three bottles of beer.

"I deeply regret my decision to drive that evening after my designated driver became unavailable," Cora said in a statement shortly after the incident. "I learned a very important lesson from this experience and take full accountability for my actions. This will never happen again."

Cora?s blood-alcohol level was determined to be .20 and .19 from two breath samples taken at the scene, according to the police report. Cora also had a blood sample taken at Goleta Valley Hospital shortly afterward that measured her BAC at .19, more than twice the legal limit.

Cora was cited for DUI and taken to the Sobering Center in Santa Barbara, where non-violent, cooperative people are sent until they sober up and are released. She has no prior DUI citations in Santa Barbara.
